Are tourist visas still available?
Many US residents may have family and friends who would like to visit them using tourist visas. Tourist visas are still available under category B-1 for business (working with business associates, attending a professional conference or short-term training, negotiating a contract) or B-2 for tourism (vacation, sightseeing, visiting friends or relatives). There is also a combination B-1/B-2 category allowing visits for both business and tourism.
The Visa Waiver Program also allows citizens from certain countries to visit the US for up to 90 days for the same reasons as tourist visas. Note that India is not on the list of the countries whose citizens can use the Visa Waiver Program.
Anyone with an active tourist visa can still travel to the US using that visa. Remember that each person in a family who is traveling to the US needs to have their own tourist visa, and there is still a delay in processing for new tourist visa applications.
How long can someone stay in the country on a tourist visa?
Tourists on a B-1 or B-2 visa can stay in the US for 6 months total in one trip. To stay more than 6 months, they will need to apply to extend their stay using the I-539 application (see below). Regardless of how long they plan to stay, make sure they do not stay past the departure date (“Admit Until Date”) that was marked on their admission stamp or Form I-94 when they arrived.
To extend a stay on a tourist visa, complete the I-539 Application to Extend/Change Nonimmigrant Status, which is available to complete online. Make sure they submit the application at least 45 days before the departure date that is on their admission stamp or Form I-94.
Should tourists carry documents and visas with them at all times?
People who are in the US on any type of visa – including tourist visas – are required to carry their visa documents at all times. While this law may not have always been enforced, there is a higher risk that they will face penalties if they do not carry visa documents under the Trump administration because of the focus on immigration policies and enforcement. At a minimum, advise any visitors on tourist visas to keep a photo of their visa and passport on their phone while in public places.
While visiting, are tourists required to register with the government?
Anyone who was issued a tourist visa and stays within the dates of their tourist visa does not need to register. Completing all the forms related to a tourist visa and arrival/departure records is enough.
The Trump administration created an Alien Registration Requirement that applies to people who arrived in the US without a valid visa or stayed in the US after they were supposed to leave. An immigrant can check whether they need to register on this website.
